1. Definitions

By simply clicking on the area you want to change, you can move, add or erase entire sections of content and modify the look of your website. All websites created through Websitegy are automatically responsive on different devices and screen sizes. No matter how skilled you are, our editor is equipped with tools that are easy enough so anyone can use them.


Payment Method: Debit card, credit card, debit card or other payment method that the User uses to pay for their Membership. Websitegy accepts Visa and Mastercard.
Services: Interactive content, encompassing text, audio, video, photographs, graphics, artwork, and other materials accessible through the Subscription.
User: The individual who access the Services and the email provided through the Subscription and furnishes their Payment Method information.

 

2. Subscription

2.1 Registration

In order to use Websitegy Services you need to complete your subscription by filling out the relevant Form providing your name, phone number, email address, billing address, credit card details (if buying Membership). Your Registration Data must be accurate to ensure its ongoing accuracy. You have the ability to update them at any time through your profile account.

2.2. Fees

You will pay your Subscription based on the country where you're registering at your local currency and/or at the local currency of the country in which Websitegyis registered. All payments are conducted through a secure SSL encrypted connection, ensuring maximum safety. Prices are subject to change at any time and by continuing to use our services you acknowledge that you accept the new fees. Further you recognize and consent that the card and billing details you furnish are valid and not stolen. These details may be disclosed to a third-party partner, including payment processors and/or acquirers. The handling of payments by other Payment Providers will be governed by their respective terms of service, and Websitegy assumes no responsibility for your dealings with such Payment Providers or for their actions

 

 

2.3 Invoicing

Upon registration, the payment method you provided will be automatically charged for the trial period fee and then automatically deducted the complete recurring fee as stated in the plans above. The Membership fee will be automatically deducted from your chosen Payment Method on the specific payment date mentioned in the reminder email. The Billing Terms may be updated at any time, with the revised fees posted on the Service. Your continued use of the Site or purchase of a Membership following these updates indicates your agreement to the new terms. The duration of your billing cycle will vary according to the subscription type you chose upon registration. If there is a failure in collecting the fees you owe (ex. due to lack of funds), you authorize Websitegy to attempt collection at a later time. Websitegy and you acknowledge that in such event, the payment date may change. Further, you acknowledge and accept that Websitegy will not seek additional authorization from you for the recurring payment. All fees must be paid in advance of the services being provided and upon registration, the purchased services will become available to you in accordance with the applicable terms. We have the sole discretion to provide a discount on a subscription payment plan without giving any prior notice.

2.4. Emails

Upon registration you will receive a welcome email. You will also receive an email with the billing information of your order and the invoice of your purchase. A reminder email will also be sent no later than 7 days before your trial period expires and/or immediately after your purchase if the trial period does not exceed the 7 days. You acknowledge that if the trial period is less than 7 days, email with your order and invoice and the reminder email may be sent as one email. If you do not receive our emails to the email provided by you upon your registration, you acknowledge that Websitegy bears no responsibility and you should contact our support teams at: [email protected].

2.5. Cancellation

If you are dissatisfied with your purchase, you have the option to terminate your Membership with Websitegy at any time. You can do so by clicking "Cancel Subscription" and following the provided instructions, or by reaching out to the customer support centre. Your account will stay active until the next billing. Access cancellation may also occur due to non-payment. Upon cancellation or termination of your Membership, the user account, operational data, and content will be permanently deleted, recovery will not be possible and you remain liable for any outstanding amounts.

2.6. Refund

You can request a 100% refund from Websitegy within 14 days of your purchase. However, Membership fees already paid are non-refundable and will be listed on your Payment Method statement with a specific identifier. Exceptions to this policy may be evaluated on an individual basis by the customer support team.

2.7. Termination

Websitegy has the authority to end your access to its services at any time without prior notice if you violate any provision of this Agreement. Access termination may also occur for reasons such as non-payment, engagement in service use that may pose a risk to Websitegy or other users, involvement in illegal or unethical activities that could harm Websitegy or other users, suspected fraudulent account activity, and participation in any other behaviour deemed unacceptable as outlined on the site or governed by the law.

 

3. General Subscription Terms

3.1. Content

Being a member of the Websitegy website g you can access, download, and engage to a variety of content, including interactive features, text, audio, video, graphics, artwork and photographs. Both Websitegy and third-party providers contribute to compiling, distributing, and showcasing this content. The accuracy, completeness, appropriateness, and usefulness of this content are the sole responsibility of Websitegy but Websitegy bears no responsibility for the accuracy of content provided by third-party providers on the site. There is no assurance from Websitegy that the posted content and information are up-to-date and suitable and Websitegy does not undertake the responsibility to actively monitor or regulate such content, although Websitegy reserves the right to modify and/or remove any part of the content. By using the website, you agree to release Websitegy from any liability arising from disputes between you and Websitegy.

3.2. License

With your Membership, you are granted a revocable, non-transferable, non-exclusive, and limited license to access and use our Services. You acknowledge that Websitegy reserves the right to terminate your license for any reason. Your usage of the Site Offerings is strictly for personal, non-commercial purposes. You agree not to undertake actions that could damage the reputation and goodwill of Websitegy or expose Websitegy or its users to any form of harm or liability. You agree to adhere to certain guidelines, such as refraining from violating the privacy rights of other users or collecting personally identifiable information without explicit consent. You also commit to abstaining from purchasing search engine or pay-per-click keywords associated with Websitegy, avoiding unethical marketing practices, and using Websitegy services only through officially supported interfaces. Any reproduction, modification, downloading, adaptation, selling, or reverse engineering of the Services is prohibited. You agree not to create derivative works, alter the Services, or use them in conjunction with third-party content in a manner that could be deemed unlawful, offensive, or fraudulent. Furthermore, you must refrain from engaging in illegal activities, including phishing, promoting harmful conduct, or violating any law or rights of Websitegy or any third party, such as intellectual property, privacy, or contractual rights. Impersonation or portraying entities in a disparaging manner without explicit approval is also prohibited. Illegal data collection, using automated devices to access or monitor services, removing copyright notices, or attempting to create competitive products are strictly prohibited. Lastly, circumventing measures restricting access to Websitegy services is not permitted.

3.3. Social Media

The Site might have links directing to Websitegy's Social Media Pages. Websitegy bears no liability for any claims or damages arising from your use or inability to use the Social Media Pages or Social Media Websites as the pages exist on third-party websites and are bound by the terms and agreements applicable to those specific platforms.

 

4. Intellectual Property

The content accessible through Websitegy services, is protected by applicable intellectual property, copyright, and trademark laws. Merely viewing the content does not confer ownership rights, and any information or material posted through the site offerings does not indicate a waiver of these rights. All rights not explicitly granted in this Agreement, whether belonging to Websitegy or its licensors, are retained by Websitegy and its licensors.

 

5. Disclaimer of Warranties

Our Services are provided "As Is," without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, or accuracy. Websitegy doesn't guarantee completeness, quality, reliability, or security of the Services. There's no assurance they'll suit your needs, comply with laws, or be free from viruses or errors.
Websitegy isn't responsible for internet connection availability or service access during peak times or system malfunctions. They're not liable for damages resulting from service use, such as profit loss, data issues, or business interruption. Websitegy won't be held liable for any claims beyond a year from the cause of action. You agree to release Websitegy from liability in any disputes.

 

6. Privacy and Anti-Money Laundry Policy

8. Opt-Outs

At any time, you have the option to opt out of receiving promotional emails and marketing communications from the sending party. You can exercise this right by clicking the 'unsubscribe' link provided in the footer of the email or by contacting the sending party directly. Once the opt-out request is received, the sending party will promptly cease sending promotional emails to the specified email address. Please note that opting out of promotional emails does not preclude the receiving party from receiving essential communications related to the services provided under this agreement.

 

9. Force Majeure

In the event that either party is unable to perform any of its obligations under this agreement because of natural disasters, war, acts of terrorism, government regulations, or any other event beyond the reasonable control of the party invoking this provision, the affected party's performance shall be excused and the time for performance shall be extended for the period of delay or inability to perform due to such occurrence. However, the party affected by a force majeure event shall promptly notify the other party in writing of the occurrence and the reasons for its inability to perform. If the force majeure event lasts for a continuous period of more than 30 days, either party may terminate this agreement by giving written notice to the other party. In such case, neither party shall be liable to the other for any damages arising out of or in connection with the termination of this agreement.

 

10. Notice of Claims of Copyright Work

If you suspect that your copyrighted work has been violated, you can submit a copyright infringement notice to Websitegy. Include your contact information (phone number, email address, and address), a signature from the copyright owner or an authorized representative confirming their authorization, detailed information about the copyrighted work (including its location on the service), and a statement asserting your good faith belief that the work is being used without lawful authorization. Additionally, confirm the accuracy of the provided details.

 

11. Indemnification

You commit to indemnify and protect Websitegy, its parent and subsidiary companies, and their respective members, officers, directors, employees, agents, co-branders, content licensors, and other partners from any claims, expenses, damages, suits, costs, demands, including attorney’s fees, and/or judgments initiated by a third party. This indemnification pertains to your inappropriate use of the Site Offerings, encompassing violations of copyright or privacy rights, breaches of this Agreement, any disputes between you and Websitegy, and/or infringements on the rights of others. These provisions are intended for the benefit of Websitegy, its parents, subsidiaries, affiliates, and their respective personnel, who may enforce these terms directly against you.

 

12. Dispute Resolution

Treating the Agreement as if executed and performed in Cyprus, it shall be governed by and construed in accordance with the laws of Cyprus (without regard to conflict of law principles). In the event that you've submitted a complaint to Websitegy and find the response unsatisfactory, you have the option to present a dispute for resolution through an arbitration Settlement Offer. This arbitration process will take place in Cyprus with a single arbitrator. Unless mandated by applicable law, each party will bear their own legal costs, irrespective of the outcome of the arbitration. While Websitegy may be entitled to claim lawyers' fees and expenses if successful in arbitration, they will refrain from seeking such fees unless the arbitrator deems your claim frivolous. We conduct our business in line with relevant EU laws on consumer protection and product liability, such as Directive 2011/83/EU and its national implementations. We do not limit or exclude liability where this would breach EU law. Except where otherwise required by law, we are not liable for indirect, consequential, or incidental damages linked to your use of our website or services. In accordance with EU Regulation No. 524/2013, consumers may file complaints through the European ODR Platform. Furthermore, to the extent permissible by law, you undertake not to initiate, join, or participate in any class action lawsuit related to any claim, dispute, or controversy against Websitegy and/or its employees, officers, directors, members, representatives, and/or assigns. You agree to an injunction to cease such a lawsuit or to remove yourself as a participant, and you also agree to cover the legal fees and court costs incurred by Websitegy in seeking such relief. This provision, preventing your involvement in class action lawsuits: does not waive any of your rights or remedies to pursue a claim individually and not as part of a class action in binding arbitration as outlined above; and constitutes a separate agreement.

 

13. Agreement

13.1. Entire Agreement

This Agreement outlines the terms and conditions governing the use of our Services and its governed in accordance with the laws of . By accepting this Agreement and utilizing our Services you acknowledge that you are at least 18 years, residence of one of the countries where Websitegy operates and you agree to abide by the terms. If any part of this Agreement is found to be invalid or unenforceable, it will not affect the validity and enforceability of the remaining provisions, which will be interpreted according to applicable law. Websitegy retains the right to assign its rights and obligations under this Agreement to any third party at any time without notice.

Websitegy reserves the right to change and modify this Agreement and the Billing Provisions at any time by posting the new version on the Website. If you continue to use our Services, you agree to be bound by the changes.
